Rahul Gandhi–Ajmal Kasab comparison row: Congress Seva Dal files cyber complaint against retired IAF officer

New Delhi: A political controversy has erupted over a social media post comparing Congress leader and Lok Sabha Leader of Opposition Rahul Gandhi with 26/11 Mumbai terror attack convict Ajmal Kasab. The Congress Seva Dal has filed a cyber complaint against retired Indian Air Force Flight Lieutenant Anoop Verma, alleging that his post was objectionable and targeted the Congress leader.

The controversy began after Verma shared a collage on X featuring photographs of Rahul Gandhi and Ajmal Kasab. Both were shown carrying bags, with Gandhi’s photograph placed on the left side of the image.

Sharing the collage, Verma wrote, “With all conviction, I can tell you guys The person on left is far more dangerous for Bharat.”

The post quickly drew criticism and triggered a political row, particularly because Kasab was the only terrorist captured alive during the November 2008 Mumbai attacks and was subsequently convicted and executed.

Following the post, the legal cell of the Congress Seva Dal said it had submitted a cyber complaint against Verma. The organisation said it intended to pursue the matter through “appropriate legal channels” and would seek action under the applicable legal provisions.

In its response, the Congress Seva Dal said it would not tolerate what it described as malicious or unlawful attempts to target Congress leaders or members. The organisation also argued that political disagreement and criticism are part of a democratic system, but alleged that equating a democratically elected political leader with a convicted terrorist crossed the line.

The Seva Dal referred to the constitutional protection of freedom of speech and expression under Article 19, while also pointing out that the Constitution allows reasonable restrictions on such freedoms. It said it would explore remedies available under the Constitution, the Bharatiya Nyaya Sanhita (BNS) and relevant cyber laws.

The organisation maintained that legal action would be pursued through due process and stressed that no individual should be considered above the law.

Retired IAF officer objects to comparison

The social media controversy also drew criticism from another retired Indian Air Force officer, Sgt Karmveer Singh. Responding to the post, Singh said that a cyber complaint had been filed and objected to the comparison between Rahul Gandhi and Kasab.

“You are comparing the Leader of Opposition (LoP) with a CONVICTED TERRORIST,” Singh wrote on X.

Singh said that political differences are a normal part of democracy, but argued that criticism should still remain within the bounds of respect and decency.

Addressing Verma’s military background, Singh wrote that having served in the armed forces should come with a sense of responsibility and decorum. He said that political criticism could be expressed without making comparisons of this nature.

“Democracy allows for deep political differences, but stooping to this level compromises basic human decency and democratic values,” Singh wrote.

The exchange has since become part of a wider political debate over the language used by public figures and political supporters on social media. The incident has also raised questions about where political criticism ends and potentially actionable online content begins.

Who was Ajmal Kasab?

Ajmal Kasab was the only one of the 10 attackers involved in the 2008 Mumbai terror attacks to be captured alive. The coordinated attacks took place across Mumbai between November 26 and November 29, 2008, killing 166 people and injuring 238 others.

Kasab was subsequently tried before a special court in Mumbai, which convicted him and sentenced him to death. The Bombay High Court later upheld the sentence.

The Supreme Court dismissed his appeal on August 29, 2012, and confirmed the death penalty after finding him guilty of several offences, including murder and waging war against the Government of India.

Kasab was eventually executed by hanging at Yerwada Central Prison in Pune on November 21, 2012, after his mercy petition was rejected.

The latest controversy involving Rahul Gandhi and Kasab has therefore brought renewed attention to the use of comparisons involving terrorism and political leaders in social media discourse. With the Congress Seva Dal indicating that it will pursue the complaint through legal channels, the matter could now move beyond the political exchange on social media and into the formal legal process.
