Modi Government Proposes Stricter Immigration Law Amid US Deportation Controversy
The Indian government is moving to tighten immigration laws with the proposed Immigration and Foreigners Bill, aiming to streamline existing regulations and place more responsibility on carriers for deported foreigners. This move comes amid recent tensions over the deportation of illegal Indian immigrants from the United States.
A Step Towards Centralized Immigration Laws
The Immigration and Foreigners Bill is one of 16 bills listed for discussion in the Budget Session of Parliament, which began on January 31. Alongside this bill, the government has also introduced The Protection of Interests in Aircraft Objects Bill and The Tribhuvan Sahkari University Bill, according to PTI.
The Budget Session is being conducted in two phases: the first concluding on February 13 and the second running from March 10 to April 4. Union Finance Minister Nirmala Sitharaman presented the Union Budget 2025 on February 1.
Why This Bill Matters
The proposed law is expected to create a unified legal framework for handling immigration, replacing multiple existing laws such as the Foreigners Act 1946, the Passport Entry into India Act 1920, and the Registration of Foreigners Act 1939.
Under this bill, the burden of ensuring that a foreigner denied entry is deported will lie with the carrier (such as airlines or shipping companies) that brought them to India.
Role of Authorities
The bill outlines the role of the District Magistrate, Commissioner of Police, Superintendent of Police, and Immigration Officers in enforcing immigration rules. These authorities will have the power to demand passenger and crew information from carriers. If a foreigner is refused entry, the immigration officer will direct the carrier to remove them from the country. The bill also states that deportation costs will not be borne by the central government but by the responsible carrier.

The Modi government is positioning this legislation as a crucial step in tackling illegal immigration, particularly concerning Bangladeshis and Rohingyas. Jaishankar assured Parliament that India is engaging with US authorities to ensure that deported Indians are treated with dignity.
