Delhi Court Dismisses Defamation Case Against Atishi, Upholds Freedom of Speech

A Delhi court has dismissed a defamation case filed by Congress leader Sandeep Dikshit against former Chief Minister Atishi and AAP MP Sanjay Singh, ruling that their statements were a legitimate exercise of their fundamental right to freedom of speech and expression.
Additional Chief Judicial Magistrate Paras Dalal stated that the remarks made by the AAP leaders during a press conference were not defamatory but rather political assertions aimed at influencing voter decisions. The court found no grounds for criminal defamation, emphasizing that political rivalries often involve sharp exchanges, which should be addressed through public debate rather than legal action.
The complaint stemmed from allegations made by Atishi and Sanjay Singh that the BJP was financially supporting the Congress in the Delhi elections, and that Dikshit had received “crores of rupees” from the BJP. However, the judge clarified that such claims, especially during elections, fall under the scope of political discourse and do not necessarily constitute defamation.
The court also noted that it is common in Indian elections for parties to accuse rivals of colluding with opponents. It stated that while some comments may seem distasteful, they should be countered in the media and public forums rather than through legal battles.
Ultimately, the court concluded that no defamation had taken place and dismissed the case, reaffirming the significance of free speech in political debates.
